What responsible lending in Townsville actually involves
We read Treasury's consultation page (August 2024) and ASIC's address, Interpreting responsible lending, of 18 November 2019, on 7 October 2026. The address is more than a year old and is the Commissioner's own account at the time. It says 'predominant' simply means 'more than half', and that a loan to an individual for business purposes secured over the borrower's home is not subject to the responsible lending obligations.
What ASIC's National Credit Code page says
ASIC's page says the Code applies to credit contracts where the debtor is a natural person or strata corporation and the credit is provided wholly or predominantly for personal, domestic or household purposes, and it adds a residential investment case. It does not say how the Code treats a facility taken out for a business, and neither do we.

A lender's own checks
The Commissioner also said a lender may choose to apply its responsible lending processes to business loans for its own commercial reasons, but that is a choice and in no way an obligation imposed by law. On that statement, a lender's own checks on a business facility are the lender's practice. We say nothing about any lender's practice, and nothing about any time-limited exemption in the Credit Regulations, because no page we read says whether one is in force.
