What unfair contract terms in Townsville actually involves

We read ASIC's Information Sheet 211 (updated March 2025) and the ACCC's contracts page on 7 October 2026. ASIC says a standard form contract is one prepared by one party without negotiation between the parties, in other words offered largely on a 'take it or leave it' basis. It says a term in a standard form small business contract is 'unfair' if it would cause a significant imbalance in the parties' rights and obligations, is not reasonably necessary to protect the legitimate interests of the party that would benefit from the term, or would cause detriment to a small business if it were to be applied or relied on.

Who decides

ASIC says a court can determine whether a contract term is unfair and that, if a court finds a term in a standard form contract unfair, the term will be void. This site does not say that any term in any contract is unfair.
